In the State of Florida one brush with the law can have devastating consequences to your future. Even if you were arrested and later completely acquitted of all the charges, your arrest is online for everyone to see, including potential employers. In certain cases, if your case meets the criteria you can have your records sealed and after 10 years under a seal, expunged. What is the difference between sealing your records and expungement? If your case meets the criteria, then you can have your records sealed. This means your records will not be available to searches and will not be online for everyone to see for the general public. However, some agencies

and departments will still have access to these records such as law enforcement. Expungement, takes place after 10 years when your records are under seal. After which you can request an expungement which means all of your records will be destroyed and only FDLE will retain a single copy of your records. Again, these records are not available to anyone but a select group of agencies and departments.

Obviously the easiest and most accurate way to determine if you qualify for sealing your records is to consult with an attorney. Many times, you may miss something or a standard for which you could have had your records sealed.

  • You have NOT plead "No Contest" or have been found guilty of a misdemeanor or felony in the State of Florida or comparable municipal code.
  • The judge ordered a "Withhold of Judication" in your case.
  • Your charges are not an ineligible offense as listed below.
  • You are not currently under community control or probation.
  • You have never sealed or expunged another record in Florida.
  • You have never been convicted of a any of the crimes for which you are seeking to have your records sealed.
